Notice of Community Meeting – Specific Land Claims

We are pleased to announce that an important Community Meeting is scheduled for Tuesday September 18th, 2012 from 6:30 pm to 9:30pm (NB Time) at the Listuguj Community Development Centre (Bingo Hall).

The Listuguj Mi’gmaq Government, along with our Negotiating Team and other engaged professionals supporting the “Out of Court Land Settlement” process will be present to facilitate a meeting to explain the following;

  •   The historical aspects of the “Out of Court Land Settlement”
  •   The ratification process
  •   The launch of a Comprehensive Community Planning Program

A Question and Answer period will follow the presentations, with the LMG negotiating team and LMG professional advisors present to answer those questions.

Specific Claims Update – July 3, 2012

Release No. 4

On June 13, 2012, the LMG Negotiating team reached an agreement in principle with Canada to settle the law suit relating to Listuguj Specific Claims, commonly known to the community as Busteed and Mann-Fraser. This is the monetary portion of these claims. The Busteed lands previously purchased by Canada are already in the final stages of being designated Reserve Lands and are dealt with in a separate process that does not require ratification by our citizens.

On Monday June 18, 2012, the LMG Negotiating Team presented the agreement in principle with Canada to Chief and Council:

$ 60 Million Settlement for Loss of use, Current Unimproved Land Value, and Miscellaneous items

$ 1.5 Million to recover the expenses incurred by the LMG

$ 1.0 Million to offset additional land and development costs

$ 2.0 Million for the cost to cure, a reconciliation item for harm done to the community,

Canada’s Offer- $ 64.5 million

In addition there is the;

$ 1.0 million as the valuation of Busteed land being returned to the Community

Only the Community Members through a Ratification process can decide on accepting this settlement. The settlement agreement will be detailed in the Ratification documents. Past expenses related to the negotiations are covered in the $ 1.5 million expense recovery item.

Specific Claims – Update from Chief Vicaire

Chief Dean Vicaire is pleased to inform the community of Listuguj that  today, June 13, 2012, he brought to the Council for their consideration, a settlement offer made by Canada, in Montreal.  This settlement offer includes $64.5 million in compensation plus return of lands (“Busteed”) to Listuguj.  Chief Vicaire notes that any offer from Canada must be ratified by the community, the conditions for which must be approved by the Council, and the people, which they represent. More details of the settlement offer will be made available to the community as they become available.

Inauguration activities will be held at the Community Center, and will include a swearing-in ceremony, followed by a Community Feast.

May 30, 2012 (Listuguj, Gespe’gewa’gi) –

On May 29, 2012, Listuguj Chief and Council held an open meeting with concerned citizens who demanded action be taken by Chief and Council and the Listuguj Police Department (LPD) on the “RNC” gang based from a house in the East end of Listuguj.  They also heard first-hand accounts about drugs, weapons, and brutality unleashed by the so-called “RNC”.

Chief Allison Metallic and Council listened intently to emotional, intense, and gut-wrenching accounts from many citizens, including mothers, about how gangsters unleashed in Listuguj untold brutality on their children and recorded it on video for the world to see on YouTube.

Chief and Council were moved to action with the full weight of legal and law enforcement resources as well as their support for a community-based “neighborhood watch” to bring to justice the criminals behind the brutal beatings of at least 5 individuals whose families came forward with details of their beatings.

Speaking for the Council, Chief Metallic stated “We will not support or endorse vigilantism” to manage this crisis.

Immediately following the public meeting a teleconference was held with the prosecutor and then with the Listuguj Police Department for an update on facts of the case and to coordinate between them an action plan to remedy the situation.

On May 29, 2012, an action plan was implemented, including:  1) immediate removal of non-Listuguj RNC gang members from Listuguj, 2) securing custody of alleged criminals in coordination with municipal, provincial, and federal law enforcement agencies, and 3) surveillance of the RNC gang house and increased patrol levels throughout Listuguj.  The action plan will be monitored by the Administration and re-addressed to the newly elected Chief and Council immediately following the election.

Successes in the fisheries

April 24, 2012

Dear Chief Metallic,

I recently  learned that the community of Ustuguj has named two Mi’gmaq fishermen as captains of a large commercial fishing boat,the Ugjit Sma’gnisg.

I would like to congratulate the new captains,Buddy  Vicaire and Rodney Barnaby, as well the whole community of Listuguj for this important achievement.

I understand that fishers in your community worked under the mentorship of non-Native fishing captains for many years before  becoming commercial fishing boat captains, and that the new  · captains will now pass on their  knowledge and experience to other  Mi’gmaq fishers.

It is very encouraging to see the Mi’gmaq people take this step towards fulfilling their vision of an independent Mi’gmaq fishery  that involves managing their own fishery and using their own commercial boats.

I look forward to hearing about  your future successes in the fisheries.

At the negotiating meeting held Thursday May 10, 2012, Canada tabled a complex and revised offer to the LMG which more than doubles the monetary   consideration.

The committee will be reviewing the contents of this offer, and then will return to the negotiation table. We are committed to advancing these negotiations for a just and fair settlement of the claim. We will continue to update the community as the file progresses.

Polling Notice 2012

  POLLING NOTICE

 Notice is hereby given to the electors of the Listuguj Mi’gmaq Band that a poll will be held to elect one (1) chief and twelve (12) councillors on Saturday, the 2nd day of June, 2012 at the following location:

DATE:                        Saturday, June 2nd, 2012

TIME:                         9:00 a.m. – 8:00 p.m.

LOCATION:              Alaqsite’w Gitpu School

22 Caplin Road

Listuguj, Qc

Please be advised that an elector can vote in person at the polling place on the day of the election in lieu of voting by mail-in-ballot.

The votes will be counted at the Alaqsit’ew Gitpu School at 9:00 a.m. on the 3rd day of June 2012.  The results will be declared immediately following the count.
